Ampleo was hired by the distribution trustee formed by a Chapter 11 plan to administer the TER Distribution Trust. Responsibilities included administering all general unsecured claims of the Trump Entertainment Resort Ch 11 plan; evaluating avoidance actions that were brought by the Trustee and supporting the litigation of such and providing accounting and financial services and oversight for the Trust.

Ampleo was appointed Receiver of Thiel Dairy, LLC, a dairy operator in Kuna, ID, on the recommendation to the Court by Rabo Agrifinance LLC, the plaintiff and secured lender (see case # CV14-18-13064). A large fire had burned down the milking parlor prior to the receiver’s appointment, and the plaintiff filed an immediate motion to install a receiver. The receiver accommodated a timely liquidation of remaining collateral and retained a real estate broker with expertise in dairies to list and sell the property. Ampleo resolved complex water rights issues, rights of redemption issues, and milk shipping rights deficiencies.

Lalani Steel is a steel wholesale distributor located in Fontana, CA. Ampleo was hired by Lalani Steel on the advice of the secured lender to create and administer a loan recovery plan.
Working with management, a recovery plan was created and reviewed with stakeholders including the owners, secured lenders, trade vendors, employees, and other stakeholders. The recommended plan called for the liquidation of non-performing inventory and fixed assets. Ampleo oversaw the implementation of the recovery plan. The secured lenders were repaid in full, and the recovery plan was accomplished out-of-court, with the company continuing as a going concern.

Ampleo administered the assets of InQpharm North America, LLC pursuant to an Assignment for the Benefit of Creditors (see case #180906024 in the Third Judicial District Court for the County of Salt Lake, State of Utah). Ampleo liquidated the assets consisting of inventory (health and wellness products), fixed assets and equipment, and goodwill, and distributed the proceeds from the sale of the assets to creditors through a prescribed claims administration process. Ampleo also pursued claims against certain customers that acted negligently in the performance of their duties on behalf of the estate’s creditors.

DBSI, Inc. was the lead case in 172 jointly administered bankruptcy cases that were filed in November 2008. The company was the originator of thousands of TIC (tenant in common) limited liability companies and limited partnerships. DBSI, Inc. through its many related companies offered investments, real estate development, and property management services to thousands of investors before its November 2008 filing. At the time of filing, approximately 25,000 claims were filed. Early in the case, an examiner was appointed who found significant comingling of funds had occurred and recommended the appointment of a chapter 11 trustee. A trustee (James Zazzali, former New Jersey Supreme Court Chief Justice) was appointed. He retained Myers & Co., Consultants, LLC as the financial manager for this complex case, who in turn retained Mr. Donovan and Mr. McKinlay as on-site managers. At the confirmation hearing in October 2010, Judge Walsh remarked that the DBSI case was one of the most complicated cases he had experienced in all his time on the bench.
Mr. Donovan’s and Mr. McKinlay’s duties, in this case, included the development of sophisticated financial models to assist with the substantive consolidation of the many entities, a forensic accounting of the Debtor’s books and records to establish grounds for substantive consolidation, the liquidation of assets including dozens of real property assets, the supervision of claims review and objection process including a focus on Secured, Administrative, and Priority tax claims resulting in the reduction of millions of dollars in tax claims and the abatement of related penalties. They also provided significant litigation support and forensic accounting to prosecute claims on behalf of the Trustee and trust beneficiaries. They are also preparing and filing the quarterly UST 2015 reports with the Court.
Mr. Donovan and Mr. McKinlay administered a liquidating plan across 22,000 creditors, with damages asserted totaling over $100 billion.

Ampleo consultants were retained by Sandy Road Farms, Inc. on the advice of the secured lender to be the company’s Chief Restructuring Officer to accomplish the liquidation of a 180,000 head hog facility. Ampleo is negotiating with impaired creditors, managing staff, and serving as the company’s sole officer.

Matt McKinlay was appointed Chapter 11 Plan Administrator of Parkinson Seed Farm, Inc., a potato grower in Eastern Idaho (see case # 18-40412-JMM US Bankruptcy Court, District of Idaho). Matt is responsible for administering the confirmed plan as entered by the Court. Matt facilitated the liquidation of several complex real estate parcels navigating complex water rights, insider tenants, deed issues, etc. Further, he sold equipment, administered claims, pursued avoidance actions, and is in the process of distributing proceeds to dozens of creditors across 9 claims classes. He solicited the cooperation of the owner and helped calm emotions to accommodate the purposes of the plan.

Ampleo was the duly appointed receiver by Washington State Court to manage and oversee a series of occupational and physical therapy clinics in Seattle, WA (see case #18-2-26203-8 SEA in the Superior Court of the State of Washington for King County). The Receiver aggressively collected aged accounts receivables, worked with a business broker to sell the clinics as going concerns retained predominantly all staff members, and accommodated an auction for surplus equipment. The Receiver managed the day-to-day operations and implemented cultural changes to stabilize the staff to keep the clinics operating effectively. The result was a full recovery to secured creditors, preservation of jobs, and a more efficient operation.

Ampleo was retained by a large potato grower on the advice of the secured lender to help restructure the company’s balance sheet, refinance debt and sell non-performing assets. Ampleo helped the owner analyze the profitability of certain varieties of potatoes and crops, optimize the crop accordingly, sell non-performing assets and restructure trade payables. Ultimately, Ampleo helped the company refinance its debt with a replacement lender on more favorable terms that freed up cash flow and enabled the company’s long-term survival.
